The legislation applies only to the kinds of goods (new or used) that are commonly used for personal, family or household purposes.
The legislation applies to goods supplied under:
- contracts of sale
- contracts for services
The legislation applies to everyone in the chain of distribution:
The legislation does not apply to private sellers.
The legislation prevents dealers who buy goods from private sellers (i.e., a consumer's trade-in) from returning any responsibility to the private seller if there is a problem with the goods upon resale. With the exception that this provision does not protect the private seller against claims for title defects or for fraud. If you believe that you have been a victim of fraud please contact the your local RCMP or municipal police department. You may also wish to seek independent legal advice.
